1. INTRODUCTION

 Welcome to SafeSip Canada. These Terms & Conditions (“Terms”) govern your access to and use of our website     www.safesip.ca, our products, services, content, and any related offerings (collectively, the “Services”).

 By accessing our website, purchasing our products, or engaging with SafeSip in any way, you agree to be bound by these   Terms. If you do not agree, you must not use our Services.

2. ELIGIBILITY & USE

 By using SafeSip, you confirm that you:​

  • Have the legal capacity to enter into binding agreements

  • Will use SafeSip products only for lawful and intended purposes

  We reserve the right to refuse service to anyone at our discretion.

3. PRODUCT DESCRIPTION & INTENDED USE

  SafeSip products are tamper-evident drink covers designed to help reduce the risk of drink tampering.

  IMPORTANT DISCLAIMERS:

  • SafeSip does not guarantee prevention of drink spiking or personal harm

  • SafeSip products are not medical or security devices

  • SafeSip is a risk-reduction tool, not a guarantee of safety

  • Users must continue to exercise personal judgment and caution

  Use of SafeSip products is entirely voluntary and at the user’s own risk.

4. LIMITATION OF LIABILITY

     To the fullest extent permitted by law, SafeSip Canada, its founders, partners, employees, suppliers, affiliates, and               representatives shall not be liable for:

  • Personal injury, illness, or harm

  • Drink tampering incidents

  • Criminal acts by third parties

  • Loss of property

  • Emotional distress

  • Indirect, incidental, special, or consequential damages

SafeSip shall not be held responsible for outcomes resulting from misuse, non-use, improper use, or reliance on the product.

5. ASSUMPTION OF RISK

   By using SafeSip products, you acknowledge and accept that:

  • Drink tampering and nightlife risks exist regardless of precautions

  • No product can eliminate all risks

  • You voluntarily assume all risks associated with use

6. ORDERS, PRICING & PAYMENT
  • All prices are listed in Canadian Dollars (CAD) unless otherwise stated

  • Prices may change without notice

  • Orders are subject to availability and acceptance

  • We reserve the right to cancel or refuse any order

Payment must be completed before shipment.

7. SHIPPING & DELIVERY

Shipping timelines are estimates only. SafeSip is not responsible for:

  • Carrier delays

  • Customs delays

  • Lost or stolen packages after delivery confirmation

Risk of loss transfers to the customer upon shipment.

8. RETURNS & REFUNDS

Returns and refunds are governed by our Refund Policy available on our website.

Due to the nature of personal safety products:

  • Opened or used items may not be eligible for return

  • Bulk or custom orders may be non-refundable

9. INTELLECTUAL PROPERTY

All content on safesip.ca, including but not limited to logos, product designs, images, text, branding, and packaging concepts, is the exclusive property of SafeSip Canada.

Unauthorised use, reproduction, copying, or distribution is strictly prohibited.

10. USER CONTENT & COMMUNICATIONS

If you submit inquiries, feedback, images, reviews, or testimonials:

  • You grant SafeSip a royalty-free, perpetual, worldwide license to use the content

  • You confirm you have the legal right to submit such content

  • SafeSip may use submissions for marketing or promotional purposes

11. PARTNERSHIPS & WHOLESALE RELATIONSHIPS

Any partnership, wholesale, or institutional engagement:

  • Is non-binding until confirmed in writing

  • May require separate agreements

  • Does not create employment, agency, or joint venture relationships

12. THIRD-PARTY LINKS & SERVICES

Our website may contain links to third-party platforms. SafeSip is not responsible for:

  • Third-party content

  • External privacy practices

  • Losses or damages arising from third-party services

13. PRIVACY

Your use of the Services is also governed by our Privacy Policy, which outlines how personal data is collected, used, and protected.

14. TERMINATION

We reserve the right to suspend or terminate access to our Services at any time, without notice, if these Terms are violated.

 
15. CHANGES TO TERMS

16. GOVERNING LAW

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes shall be resolved exclusively in Ontario courts.

17. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
